1. Acceptance of Terms
By accessing or using TurboCall's website, platform, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
2. Description of Services
TurboCall provides an AI-powered voice agent platform that enables businesses to automate inbound and outbound phone calls. Our Services include call automation, voice AI agents, CRM integrations, call analytics, and related tools.
TurboCall optionally integrates with Google Calendar via OAuth to check your availability before scheduling or placing calls — helping ensure AI agents do not interrupt you during busy calendar times. This integration requires your explicit authorization and can be revoked at any time.
3. Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your account information
- Keep your login credentials secure and confidential
- Accept responsibility for all activity under your account
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable laws or regulations, including TRAI regulations, the TCCCPR/DLT framework, and do-not-call (DND) requirements
- Send unsolicited or unauthorized communications
- Impersonate any person or entity
- Transmit harmful, offensive, or illegal content
- Interfere with or disrupt the integrity of the Services
- Attempt to gain unauthorized access to our systems
- Resell, redistribute, sublicense, rent, lease, or white-label the Services or your access to them without a separate written agreement with TurboCall
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code, AI models, or underlying technology of the Services
- Use the Services to build, train, or operate a competing product or service
5. Google OAuth & Third-Party Integrations
When you authorize TurboCall to access your Google account or other third-party services, you agree to the following:
- You are the authorized account holder or have permission to grant the requested access
- TurboCall will access only the data scopes shown at authorization, and only for the purposes described in our Privacy Policy
- TurboCall will not use Google user data — including Google Calendar data — for advertising, AI/ML training, or any purpose beyond delivering the integration feature
- You may revoke TurboCall's access to any third-party integration at any time via your TurboCall account settings or directly through the third party's authorization management page
TurboCall's use of data received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
6. Billing and Payments
Paid plans are billed on a monthly or annual basis. You agree to pay all fees associated with your selected plan. Fees are non-refundable except as required by law or as stated in our 30-day money-back guarantee for first-time subscribers.
We reserve the right to change pricing with 30 days' prior notice. Continued use after a price change constitutes acceptance of the new pricing.
7. Intellectual Property & License
All content, features, and functionality of the Services — including the software, source code, AI models, text, graphics, logos, designs, and the "TurboCall" name and brand — are owned by TurboCall and protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws.
The Services are licensed, not sold. Subject to these Terms and your payment of applicable fees, TurboCall grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your own internal business purposes only. You acquire no ownership of, or rights in, the underlying software or source code.
You may not copy, modify, distribute, resell, sublicense, white-label, reverse-engineer, or create derivative works from the Services without our prior written consent. All rights not expressly granted to you are reserved by TurboCall.
8. Your Content
You retain ownership of any content you provide through the Services (call scripts, contact lists, recordings, etc.). By using our Services, you grant TurboCall a limited license to process this content solely to deliver the Services to you.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may suspend or modify the Services for maintenance, updates, or unforeseen circumstances. We will provide reasonable notice when possible.
10. Limitation of Liability
To the maximum extent permitted by law, TurboCall shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Services.
Our total liability shall not exceed the amount paid by you to TurboCall in the twelve (12) months preceding the claim.
11. Termination
Either party may terminate these Terms at any time. You may cancel your account through your account settings or by contacting support. We may suspend or terminate your access if you violate these Terms or engage in harmful activity.
Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days to allow for export, after which it may be deleted.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872 and the Information Technology Act, 2000, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
